The website www.tracktrailing.at was created by Jacqueline Musil and is part of the services offered by the dog training school Wegbegleiter Hund – Tiertraining Musil e.U.

For reasons of simplicity and readability, the masculine form is used in this document. The feminine form is naturally included at all times.

These General Terms and Conditions apply between the sole proprietorship Hundeschule Wegbegleiter Hund – Tiertraining Musil e.U., hereinafter referred to as Wegbegleiter Hund (operated by Jacqueline Musil), and the contracting party, hereinafter referred to as the Customer.

Wegbegleiter Hund provides all services in the field of dog training and canine behavior consulting exclusively on the basis of these General Terms and Conditions.

Wegbegleiter Hund reserves the right to amend or supplement these General Terms and Conditions at any time. The version valid at the time of booking shall apply; this version can be viewed on the website at www.wegbegleiterhund.at and www.tracktrailing.at. For bookings already made, the version valid at the time of booking shall apply.

2. Offer and Conclusion of Contract

All offers published on www.wegbegleiterhund.at and www.trackrailing.at are subject to change and non-binding. Changes are reserved.

Requests to participate in the training program must generally be submitted online via the contact form on the website www.tracktrailing.at or by email to office@tracktrailing.at. Wegbegleiter Hund reserves the right to subsequently submit a training offer to the customer. The binding acceptance of the offer must be made in writing by the customer to the dog training school Wegbegleiter Hund via the contact form or by email.

Training and consultation sessions agreed verbally or by other means (Facebook, WhatsApp, SMS, and the like) are generally binding.

3. Prices and Payment Terms

Current course dates and prices can be found on the website www.tracktrailing.at. Prices and dates are subject to change. Wegbegleiter Hund reserves the right, by prior agreement with the customer, to charge a flat-rate travel expense fee. Otherwise, travel expenses will be charged at EUR 0.70 per kilometer. The prices communicated at the time of the inquiry shall apply.

Payment for participation in group programs must be made no later than 14 days after receipt of the invoice and must in any case be completed before the first training session. Registration is only valid in conjunction with full payment of the course fees.

Payment for individual sessions must be made in advance by bank transfer or in cash directly at the beginning of the individual session.
Online 1:2 training sessions must be paid in advance. Payment by invoice is possible by prior arrangement.

Payment for online courses must be made immediately upon receipt of the booking confirmation.

In the event of late payment, the right to participate expires.

4. Cancellation Policy

Delays by the customer to agreed appointments are at the customer’s expense and do not entitle the customer to any reduction of the fee.

If the customer is unable to attend, there is no entitlement to a replacement appointment.

Individual consultations / Individually bookable group training sessions (face-to-face / online):
In the event of cancellation less than 48 hours before the start of the training or in case of non-attendance, the full fee is payable.
For cancellations made between 7 days and 48 hours before the start of the training, 50% of the costs for an individual consultation of the planned duration will be charged.
Cancellations made earlier than this are free of charge.

Courses (face-to-face):
Free cancellation is possible up to 21 days before the start of the course.
For cancellations up to 7 days before the start of the course, 50% of the course fee will be charged.
For cancellations within 7 days before the start of the course or in case of non-attendance, the full fee is payable.
If you miss or are unable to attend a booked training program (e.g. due to illness), no refund or rescheduling is possible. In the event of illness of your dog, you may attend without your dog.

Workshops / Seminars (face-to-face / online):
For cancellations between 30 days and 14 days before the start, 50% of the fee will be charged.
For cancellations less than 14 days before the start or in case of non-attendance, the full fee is payable.
Cancellations made earlier than this are free of charge.

Online courses:
Registration for online course offerings is binding. A free cancellation without stating reasons is possible up to a maximum of 14 days after conclusion of the contract.

Any cancellations must be submitted exclusively in writing. Receipt of the cancellation must be confirmed in writing by Wegbegleiter Hund.

300-minute blocks are valid for a maximum of 12 months from the invoice date and are non-refundable.

5. Obligations of the Customer

The customer warrants that their dog is vaccinated, officially registered with the authorities, and covered by liability insurance. The required documents must be presented upon request.

The customer warrants that their dog does not suffer from any contagious diseases.

The customer is obliged to inform Wegbegleiter Hund proactively, fully, and truthfully before the start of the first training session about any illnesses and/or parasite infestations and/or behavioral issues of their dog, such as excessive aggression or fearfulness.

The customer is obliged to inform Wegbegleiter Hund, where applicable, about the heat cycle of their female dog. Wegbegleiter Hund will seek individual solutions for participation in the training. Wegbegleiter Hund is entitled to exclude dogs in heat as well as dogs with contagious diseases from training. However, the customer may attend the training without their dog.

6. Cancellation of Training Sessions and Exclusion from Participation

Clause 6 applies to both face-to-face and online offerings.

Wegbegleiter Hund reserves the right to cancel group programs due to an insufficient number of participants. In this case, any course fees already paid will be refunded in full.

If agreed appointments are canceled due to unforeseen circumstances on the part of the dog training school Wegbegleiter Hund, Wegbegleiter Hund is obliged to offer a replacement appointment.

Jacqueline Musil is entitled to be represented at any time by another qualified dog trainer.

Wegbegleiter Hund reserves the right to refuse participation in group training to dog owners without stating reasons.

Wegbegleiter Hund further reserves the right to exclude customers from training with immediate effect

  • who act contrary to the philosophy of Wegbegleiter Hund, in particular if they apply physical or psychological violence against their dog,

  • whose inappropriate behavior disrupts the smooth conduct of a training session,

  • whose participating dog poses a danger to persons or property.

In such cases, course fees remain payable in full.

7. Liability (Face-to-Face / Online)

Any liability of Wegbegleiter Hund (Jacqueline Musil) for personal injury or property damage is excluded unless there is gross negligence or intent on the part of the dog trainer. Wegbegleiter Hund is not liable for damages caused by third parties or their dogs. The customer or dog owner assumes sole and full liability for their dog at all times.

In the event of deliberate concealment of behavioral issues or illnesses, all resulting damages shall be borne in full by the customer or dog owner. Wegbegleiter Hund assumes no liability for damages or health consequences arising from incomplete information provided by the owner.

For damages caused by the dog during training or therapy to third persons, animals, or third-party property, as well as for bite injuries or injuries caused by falls, the customer or dog owner alone shall be liable, except in cases of grossly negligent conduct on the part of the trainer.

If the dog becomes ill or injured as a result of training or therapy, liability on the part of the trainer is excluded, except in cases of gross negligence on the part of the trainer.

Participation in the training programs is at the participant’s own risk. Training instructions are to be understood as suggestions—the actual implementation is the sole responsibility of the dog owner.

Parents are liable for their children.

It is expressly pointed out that the exercises carried out document only the current condition of the animal, and that any prognosis can only be made regarding the probable future behavior of the animal. The animal’s behavior may be subject to situational fluctuations, and no liability is assumed for the occurrence of the prognosis made. Wegbegleiter Hund does not guarantee the achievement of the training goal.

a) Video and audio recordings may only be made by the customer with the prior written consent of Wegbegleiter Hund. Private photographs may be taken after verbal consent has been given by Wegbegleiter Hund. The trainer’s instructions must be strictly followed in this regard. The publication of such recordings by electronic means, in print media, and in all other media—excluding social networks—also requires the prior written consent of Wegbegleiter Hund.

b) Photos, audio recordings, and video recordings may be made by the trainer or persons authorized by the trainer. By participating in the training, the customer grants Wegbegleiter Hund permission to use these recordings for private and commercial purposes in all print and electronic media, in particular on the internet, as well as in all other media, including future media. Any claim to commission or other remuneration, as well as claims based on personal rights, are generally excluded unless otherwise agreed in writing in advance. The customer has the right to object to this consent in writing in advance or at the start of the training. A subsequent objection is not possible.

No data will be transmitted to third parties.

Newsletter (currently not in use)

You have the option to subscribe to our newsletter through our website. For this purpose, we require your email address and your confirmation that you agree to receive the newsletter. Once you have registered for the newsletter, we will send you a confirmation email with a link to confirm your subscription. You can cancel your newsletter subscription at any time. Please send your cancellation to the following email address: office@tracktrailing.at. We will then immediately delete your data related to the newsletter.

Your Rights

You generally have the right to access, correct, delete, restrict, and transfer your data, as well as the right to withdraw consent and object to data processing. If you believe that the processing of your data violates data protection law or that your data protection rights have otherwise been infringed, you have the right to lodge a complaint with the supervisory authority.
